GENERAL TERMS OF USE of the Glidy.net Service

Welcome to Glidy.net, a Service providing internet access to a community platform, implemented and operated online by C@VOK.

These General Terms of Use apply to the users and passengers of the Glidy.net platform.

Certain contractual provisions relating to professional air operators are not reproduced in this public version. Operators have specific collaboration terms available upon request from C@VOK.

Glidy.net enables the connection between Advertiser-Air Operators and Travelers-Passengers, referred to as "Users," who can jointly organize and carry out flights in aircraft, in accordance with the General Terms of Use and terms defined below and in Appendices 1, 2, and 3.

These Glidy.net Service Terms of Use govern the relationships established between all Users of the Service, Air Operators, and Passengers, as well as the relationships between C@VOK and the users. They define the legal framework for the use of the Glidy.net website and the services offered. They specify the conditions for accessing and using the services by all Users, Air Operators, and Passengers.

The General Terms of Use are directly accessible under the "CGU" section or via the hyperlink at https://www.glidy.net/p/terms-and-conditions. Other hyperlinks refer to all sections appearing in the CGU or CGU Appendices as follows:

These General Terms of Use include the Common General Conditions as well as the Special Terms of Use for Air Operator Users (Appendix 1), Traveler-Passenger Users (Appendix 2), and Partner Users (Appendix 3), which concern the services offered by the Glidy.net site.

Access to or use of the Service implies the unreserved acceptance of these Terms of Use in their entirety and without restriction, which are accessible on the Glidy.net site.

By accepting the General Terms of Use in their entirety, the User can create their account and become a Member of the Glidy.net site.

If you disagree with the terms of the General Terms of Use presented below, please do not use the proposed services and leave the site.

In the event of a breach of any of the provisions set out in these General Terms of Use and/or its Appendices 1, 2, and 3, which together form an indivisible document, C@VOK reserves the right to delete the account of the person concerned, whether they are an Air Operator or a Passenger.

These General Terms of Use are those of the Glidy.net site, published by C@VOK and the private flight charter service offered by the Glidy.net site.

Glidy.net acts exclusively as a technical and commercial intermediary between passenger users and professional air operators.

The company C@VOK, which operates the Glidy.net platform, does not directly sell air transport services and only acts as a connecting intermediary.

Consequently, the transport contract is concluded exclusively between the Passenger and the Air Operator concerned.

In the event that these General and Special Terms of Use are translated into any foreign language, the French language shall remain the reference language for any dispute, contradiction, claim, or simple hesitation regarding interpretation.


I – On the General Terms of Use

I.1 Scope and Definitions

These General Terms of Use apply to the services offered by the Glidy.net site.

The private jet charter service offered on this website is published by the company C@VOK, an SAS (simplified joint-stock company) with a capital of 1,000 Euros, registered with the Romans Trade and Companies Register under number 898640818, and whose registered office is at 115 Chemin de la Moutette – 26160 Saint Gervais sur Roubion. (Hereinafter "C@VOK").

The website is hosted by O2switch - Che des Pardiaux, 63000 Clermont-Ferrand, and Tradly.app - a Product of iSTRATA DIGITAL Sdn Bhd (1332267A), a Malaysian digital status company.

We have given a specific meaning to certain words used regularly in these General Terms of Use, including the specific conditions in Appendices 1 and 2. These words begin with a capital letter.

Below are their definitions:

  • "Site": Refers to the website accessible at www.Glidy.net (Hereinafter "glidy.net").

  • "C@VOK": Refers to the company that owns and manages the www.glidy.net site, an SAS with a capital of 1,000.00 euros, domiciled at 115 Chemin de la Moutette – 26160 Saint Gervais sur Roubion, registered with the Romans trade and companies register, n° 89864081800016 Siret, civil liability insurance provided by Hiscox.

  • "CGU": Refers to these General Terms of Use.

  • "Aircraft": Any device capable of moving in the air: here, a plane (private jet or business jet), a helicopter, a drone.

  • "Private Flight": The rental of an Aircraft with a pilot for exclusive use and for a determined route, schedule, time, and price.

  • "Empty Leg Flight": Each private jet performs an "Outbound" flight and a "Return" flight per journey. The empty leg flight concerns one of the two flights, the outbound or the return flight, which is "empty" because it is not used by the initial passenger(s), or the flight to another airport when it involves picking up another passenger.

  • "Route": The circuit of a flight proposed by the Advertiser-Air Operator, which may simply consist of a point A to a point B (including take-off and landing), or include a stopover at a point C, or a round trip to the same point.

  • "User": Generally, any person with access or a possibility of access to all or part of the Site.

  • "Member": Any User who has finalized a reservation on Glidy.net after providing all information useful for its validation by Glidy.net and after accepting the General Terms of Use.

  • "Advertiser": Any Air Operator accepted as a Member by the Glidy.net team.

  • "Reservation": The formalization, through the reciprocal acceptance of the link and the terms of agreement between the Air Operator and the future passenger, and by the allocation of a seat on a determined flight.

  • "Price": The price of the flight requested by the Air Operator and accepted by the future passenger.

  • "Service Fees": Fees levied by Glidy.net on the Price agreed upon between the Air Operator and the Passenger User and paid by the latter for the flight subject to the Reservation.

  • "Air Operator": Refers to the operator of the aircraft(s) who is duly registered with their civil aviation authority and who operates a flight with an AOC or CTA (Air Carrier Certificate) and a valid license.

  • "Partner Users": Refers to the operator of the aircraft(s) who has subscribed to a partnership program on the Glidy.net site.

I.2 Modification of the General Terms of Use

C@VOK reserves the right to modify the General Terms of Use, the functionalities offered on the Site, or the operating rules of the site at any time.

The modification will take effect immediately upon the online posting of the modified CGU and notification by e-mail to any Member. Use of the Service after notification of the General Conditions constitutes acceptance of the modified CGU.

Such a modification cannot apply to a transaction in progress, i.e., a reservation already paid for or currently being paid for.


II – Purpose

The Glidy.net site provides its Members, corporate clients, or simple travelers, with the opportunity to charter a private aircraft flight to any destination and benefit from a highly attractive price far removed from the initial price, as the flights proposed by the Advertisers represent only so-called "Empty Leg" flights.

Glidy.net allows for savings of up to 70% on the usual price of an aircraft flight, regardless of the desired destination.

The saving realized may be less if the initial empty leg flight plan must be slightly modified to meet a specific request.

Glidy.net regulates the connection between Advertiser-Air Operators and Traveler Users, by providing them with the possibility, through their reciprocal advertisements and requests, to formalize a private jet flight reservation, for leisure or professional travel.

As such, Glidy.net is only a platform organizing intermediation between advertisers and users. It allows access to private aviation at a very affordable cost, it being specified that Gligy.net is only at the initiative of this service and does not operate private aircraft itself. It collects Service Fees in return.


III – Use of the Service

III.1 Registration

Becoming a Member is open to natural and legal persons.

Becoming a Member is subject to providing the following information:

  • Civil status (first name and last name or company name).

  • K-bis excerpt less than 3 months old for companies.

  • Email address.

  • Mobile phone number.

  • Air Carrier Certificate for companies.

  • Valid current year Civil Liability Insurance.

  • Acceptance of the General Terms of Use of the proposed Service.

The Member vouches for the truthfulness of the information and documents they provide, and the Glidy.net team reserves the right to verify their accuracy. In the event of insufficient information or guarantee of their truthfulness, the Glidy.net team reserves the right to delete the User account concerned without delay.

The advertiser undertakes to report any change to the information provided within 15 days, failing which their account will be deleted.

The Glidy.net team reserves the right to refuse or strike off a registration to the service and will notify the Member of the reason. Termination of the service includes termination of all ancillary services.

III.2 Insurance

The Member undertakes that the insurance contract provided on the day of their registration is valid throughout the duration of their registration and underwritten with a notoriously solvent company throughout the duration of their registration.


IV – Liability

As C@VOK only acts as an intermediary in the relationship between Users and merely provides them with a connection tool, its liability cannot under any circumstances be engaged regarding inaccuracies, errors, imprecisions, the reliability, quality, and completeness of the information exchanged between Users and provided for information purposes on the website, nor for difficulties in the implementation of the services and provisions agreed upon between them, nor in the definition of the flight, schedules, flight conditions, the chosen aircraft, or the identity of the pilot.

The company C@VOK cannot under any circumstances be held liable as a carrier, a status it does not possess. Consequently, C@VOK excludes all liability for itself, its current and future associates, partners, affiliated companies, officers, employees, agents, representatives, successors, or assigns for any injury, death, loss, accident, cancellation, or delay arising from or in connection with these General Terms of Use, the services made available to Users, any service obtained and agreed upon via or from the Glidy.net site.


V – Limitation Period and Disputes

V.1 Limitation Period

Any claim against C@VOK shall be time-barred after a period of one year. After this period, any outstanding and unclaimed amount will be acquired by C@VOK.

V.2 Competent Courts

These General Terms of Use are governed by French law.

Any claim must be addressed within a maximum period of fifteen (15) days after the execution or the planned date of execution of the Service subscribed by the User to the following address: C@VOK – 115 Chemin de la moutette – 26160 Saint Gervais sur Roubion

Any dispute that may arise during the execution or interpretation of these CGU must first be the subject of an attempt at amicable settlement.

In case of impossibility of amicable agreement, the competent jurisdiction will be considered to be the courts of the location of the C@VOK company's headquarters.

In the event that the General and Special Terms of Use are translated into one or more languages, the language of interpretation will be French in the event of a contradiction or dispute over the meaning of a term or provision.

SPECIAL TERMS OF USE

of the Glidy.net service


I – Common Provisions

I.1 User Account

Single Account: Every User undertakes to create only one Account on the Glidy.net Site, and to use it only for personal purposes with the personal information they have provided, whether under their own identity or that of third parties. Any deviation from this rule must be subject to an explicit request from the User followed by express and specific authorization from the Glidy.net team. Creating or using new accounts under their own identity or that of third parties without requesting and obtaining the authorization of the Glidy.net team may result in the immediate suspension of the User’s accounts and all associated Services.

Personal Nature: Acts, commitments, and agreements performed via the personal account are considered to have been made by the User themself.

Data Update: Every User undertakes to regularly update their information by logging into their account, not to transfer their Account to a third party or another User, and to keep their Identification Codes confidential.

Loss of Identifiers: In the event of forgetting, misuse, or unauthorized use of their Identification Codes, C@VOK's liability cannot be engaged under any circumstances. The User must immediately inform Glidy.net of this situation by email to: admin@glidy.net.

Account Deletion: Any User may delete their Account by logging into the Site, subject to respecting the commitments made to another User.

Furthermore, C@VOK reserves the right to delete a User Account in the event of:

  • Violation of a provision of the General Terms of Use;

  • Misappropriation of the services offered by the site;

  • Failure to log into their User Account for a period of two (2) years and after sending a reminder email that remains without effect for eight (8) weeks;

  • Harm caused by a User to other Users.


I.2 Use of the Network

CAPACITY Every User declares and certifies that they have reached the legal age and have the capacity to enter into a legally binding contractual agreement, or to accept these general conditions and any transport contract they may conclude on the Glidy.net site. Consequently, every User declares that they are not subject to any restriction that would make the conclusion and signing of such a contract impossible.

ETHICS Every User undertakes not to provide any false information, not to make any false or fraudulent requests, not to make a request or conclude a contract on behalf of a fictitious user, under a false name, with an invalid credit card, or using fraudulent information. Any User engaging in such acts will be prosecuted and may incur civil and criminal liability, according to applicable law. No User may use the network to submit requests or conclude a contract in the name and/or on behalf of third parties, unless legally authorized to do so by the Glidy.net team.

Every User undertakes not to link to external content such as personal pages, not to disseminate malicious, disparaging, deliberately misleading, unlawful information, and/or information contrary to public decency or these terms. They shall not disseminate sensitive information relating to racial or ethnic origin, political, philosophical, or religious opinions, trade union membership, sexual life, or health, or information contrary to public decency and the law, and shall comply with public policy provisions. Failing to comply with all these provisions, the Glidy.net team may delete the User's Account. Every User expressly accepts that the use of the network is made at their own expense and risk.


II – For Carrier Users

II.1 License and Certificates

Every carrier User and Aircraft Operator Advertiser must be able to provide proof, as of the date of account creation and at any other time upon simple request, of an air carrier certificate, an approval that must have been issued by the air transport supervisory authority and which attests to their capacity to safely provide passenger transport flights.

II.2 Insurance

Each aircraft must be covered by insurance covering the passengers, their baggage, and third parties on the ground. Pilots, for their part, must be covered by individual accident insurance, which is generally taken out when they pay their flight license contributions. Every aircraft owner and every pilot must be able to provide proof of this upon simple request.

II.3 Terms of Service Use

- PRELIMINARY REGISTRATION: To access the services offered by the Glidy.net site, every Operator Advertiser or Carrier must have member status, which is acquired through preliminary registration. Registration for the service requires the production of certain documents justifying: the identity of the company's pilots, the status of Air Operator, a valid license, their right to use the aircraft, all patents, diplomas, and/or qualifications, a medical certificate, the Instrument Flight Rules (IFR) qualification if necessary and if the company is authorized to operate IFR transport flights, a mountain flight qualification (if required for the country), authorization to land in a field or DZ (drop zone), and an appropriate qualification if the departure or arrival airfield requires it. Failing this, C@VOK reserves the right to refuse any registration or to terminate the registration of any carrier whose behavior is contrary to the ethics of Glidy.net, these General and Special Terms of Use, or whose administrative authorizations prove to be expired.

- POSTING AN ADVERTISEMENT: Any Carrier User who has acquired member status may post advertisements. Every advertisement must specify:

  • The type of Aircraft used for the Route

  • The number of available seats

  • The departure location

  • The arrival location

  • Stopovers or transit locations, if any

  • The Price

  • The meeting location and time

  • The pilot's name (if available)

  • The type of cancellation conditions they wish to impose on the Passenger

  • The rules and any supplementary fees that may be charged to the Traveler as part of the Flight

  • The number of bags allowed per passenger (skis, suitcases, and packaging, etc.)

  • Customs specifications for embarkation or disembarkation

  • Whether animals are accepted and under what conditions

  • Additional costs for other services

Every advertisement must reiterate:

  • The prohibition on transporting hazardous materials

  • The prohibition on transporting weapons

  • The prohibition on transporting drugs or any other illicit product or object

- PRICE: The charter price is agreed upon in the currency agreed by both parties. It must be paid directly into the account indicated by the Glidy.net team, which is authorized to collect payment for the carrier's services. This sum must be received in available funds in the said account no later than two weeks before the flight date indicated in the charter contract. When flights are booked less than two weeks before the departure date, immediate payment of the full charter price must be made upon Reservation. The agreed charter price is based on fuel costs calculated on the day of Reservation. If, for any reason, these fuel costs increase between the Reservation date and the flight date, the carrier may request the charterer to pay a sum that fully offsets the increase in fuel costs. If the charterer requests a change of itinerary or any other modification of the terms of the agreement (change of schedules, number of passengers, change of airport, or other) for one or more flights reserved with the carrier, and the latter is able to satisfy their request (which remains at their entire discretion), Glidy.net will then issue a new flight confirmation, and the charterer will have to pay any additional costs that their request may have caused. Air taxes and charges (passenger tax, airport tax, etc.) are determined and collected by the Air Operators in accordance with applicable regulations. Glidy.net is not involved in their calculation or collection. The company C@VOK only declares and invoices the VAT applicable to its own intermediation commissions. The Advertiser remains solely responsible for the payment of taxes due for air transport.

- CONFIRMATION AND ISSUANCE OF THE TRANSPORT DOCUMENT: Any confirmed Reservation will be sent to the Glidy.net team, which will issue a flight confirmation, constituting a transport document intended for the passenger, within a maximum of 6 hours. This will be sent to them by e-mail to the address they provided. This document will summarize all the flight information and must be handed over to the pilot upon arrival at the agreed meeting point. The ticket number must be entered in the operator's administrative section to confirm to the Glidy.net team that the flight with all passengers has been completed.

II.4 Liability

- FAILURE AND REFUND: In the event of a technical failure of the aircraft, rendering the carrier unable to provide a flight under the conditions specified in the flight confirmation, the operator must propose an alternative solution. Failing this, and if they simply cancel the flight, the client will be refunded, minus the site's Service Fees. No financial compensation will be granted by C@VOK. Bank fees are retained by C@VOK. Glidy.net, not being a party to the transport contract, cannot be held responsible for the execution of the flight, delays, cancellations, or itinerary modifications attributable to the Air Operator. Glidy.net's liability is limited to the proper execution of the connection service and the reliability of the information published on the platform, within the limits provided by law. Any claim related to a flight must be addressed directly to the Air Operator concerned. In the event of cancellation due to meteorological reasons or force majeure, the client will be refunded, minus the site's Service Fees. No financial compensation will be granted by C@VOK. Bank fees are retained by C@VOK. In the event of a delay on flight connections, no financial compensation will be granted by C@VOK. The client is deemed to have previously accepted and validated all the conditions of the offer. They are irrevocably bound and cannot request a refund in the event of cancellation on their part, for whatever reason.

- COMPLIANCE WITH CONTRACTUAL CLAUSES: The carrier undertakes to make every effort to absolutely respect all the terms of the agreement concluded with the Passenger User. To do this, they must:

  • Make the aircraft subject to the Reservation available to the traveler at the scheduled departure time, with the necessary equipment and fuel, and in the airworthy condition required by the laws and regulations of the country in which it is registered.

  • Throughout the duration of the flight(s), use the aircraft subject to the Reservation in compliance with the laws and regulations in force for the transport of passengers.

  • Reasonably employ all means to ensure that the aircraft and its crew are ready for take-off at least 30 minutes before the agreed time and in view of practical requirements, and, if necessary and according to agreement, arrange for passengers to be met upon their arrival at the airport at the business terminal or the planned meeting point, by a staff member or a member of a company designated by the operator who will then be in charge of the reception. In this second case, the site cannot be held liable in the event of difficulty arising during the passenger's reception.

II.5 Payment

Each stage of the Reservation, up to the payment validation, is followed by an e-mail addressed to each interested party. Payments made by passengers are processed securely via the approved payment service provider (Stripe or Mangopay), in accordance with applicable regulations.

II.6 Service Fees

Glidy.net levies Service Fees on the Site included in the announced flight price. These Service Fees are included in the contribution or the price requested from the passenger.


III – For Traveler Users

III.1 – Preliminary Registration

To access the services offered by Glidy.net, every Traveler-Passenger User must have member status, which is acquired through preliminary registration. Registration for the service requires the production of certain documents justifying the User's identity. The Glidy.net team will request from them:

  • An identity document (not retained);

  • A valid email address;

  • A billing address if different from the postal address provided.

III.2 Reservation

a- Formalization Any flight Reservation request is made as follows: Depending on their request, the Passenger must take note of the following elements:

  • The meeting places, dates, and times of the envisaged flight;

  • The applicable cancellation conditions;

  • The cost to be paid, which includes:

    1. The amount passed on to the Advertiser,

    2. If necessary, the complementary costs expressly mentioned in the Advertisement (consumables, cleaning, etc.),

    3. The amount of Service Fees invoiced by C@VOK. The passenger must declare that they have taken into account any additional charges invoiced to them.

b- Validation When the flight proposal corresponds to the Passenger's request, to validate it, they are invited to follow the payment procedure as follows:

  • A summary email of the Reservation request and all its details listed above in III.2-b is sent to the Passenger.

  • A summary email of this same request is sent to the Advertiser. Both then have a period of twelve (12) hours to formally accept or refuse it. Failing this, the Reservation request is canceled, and the Passenger is informed by e-mail.

c- Payment The Passenger is only invited to pay the amount of their Reservation upon its acceptance by all Users. To make payment for their Reservation, the Passenger must pay by bank card or bank transfer after accepting the CGV. Their order status is "pending." Upon validation of the payment by the banking institution, this information is transmitted to the Advertiser User, who again has forty-eight (48) hours to definitively accept the Reservation. In case of transaction failure due to a negative return from the banking institution, the Glidy.net team will immediately inform the Passenger and cannot under any circumstances be held responsible for this refusal or the reason for it, whatever it may be. The Passenger is only debited the paid amount upon the operator's acceptance of the Reservation request. Subsequently, the status of their order changes to "completed," and the flight tickets are made available with the invoice. The sums received by C@VOK are kept in an escrow account with C@VOK. The sums thus deposited are allocated to the payment of the Reservation. The payment orders given by the Users in accordance with these terms are irrevocable. If necessary, each User undertakes to respond favorably to any request from C@VOK or any competent administrative or judicial authority relating to the prevention or fight against money laundering and, in particular, they accept to provide any relevant proof of address or identity. In such an event, and in the absence of an immediate response from Users, C@VOK will be authorized to take any appropriate measure, notably the freezing of sums paid and/or the suspension of services used by the Passenger or offered by the Advertiser. Payment to Advertisers will only be made in favor of Advertisers who have opened a bank account in their own name. For any payment or transaction carried out via the platform, the user acknowledges that the processing service is provided by an approved payment service provider acting as a regulated financial intermediary. Glidy.net and C@VOK disclaim all responsibility in the event of a malfunction attributable to these providers.


IV – For Partner Users

Glidy selects its airline partners based on compliance and quality of service criteria.

These operators have the necessary licenses and authorizations to operate private or shared flights in accordance with current regulations.

In the event that the General and Special Terms of Use are translated into one or more languages, the language of interpretation will be French in the event of a contradiction or dispute over the meaning of a term or provision.
